ngena Privacy Policy

1. Introduction

ngena USA LLC attaches great importance to protecting personal data. This privacy notice provides information about the processing of your personal data by ngena if you access the websites operated by ngena (the “Websites”): <https://www.ngena.net>,<https://www.quicksizer.net> (“QuickSizer.net”) and <https://ngena-my.sharepoint.com> (“Repository”), and if you communicate with ngena by other means, in accordance with the requirements of the General Data Protection Regulation (“GDPR”).

2. What data is collected and how is it used?
2.1 Log files
When you visit the Websites, ngena temporarily records the IP address of your device, the name and URL of the requested file, the http response code, the browser and operating system of your device, the time of the visit and the website from which you are visiting. The log files with the recorded data are used for the security purposes, in particular, to protect against attempted attacks on ngena systems, and for statistical analysis (the legal basis for data processing is Art. 6 (1) (f) GDPR). The log files are not used to create individual user profiles and they are deleted after 7 days.

2.2 Cookies
ngena uses cookies on the Websites, including cookies which are essential for functionality of the Websites (“necessary” cookies) as well as cookies which allow to learn more about Websites’ visitors and optimize content, services and communication (“analytics” cookies), as well as tracking technologies.

2.3 Communication with ngena
When you send an email to ngena or initiate communication with ngena by other means, ngena will receive your contact data (e.g. an email address), the content of communication and other details that you have voluntary provided (the legal basis for data processing is Art. 6 (1) (a) GDPR). ngena will retain your contact data and details of communication as long as needed to process your inquiries and to respond to you. Of course, you can request ngena to stop processing your data or to delete your data at any time.

If you communicate with ngena in the course of business relationship with ngena, ngena will store the contact details you provided and content of communication for the purpose of working on a respective business project (the legal basis for data processing is Art. 6 (1) (b) GDPR if you are ngena’s partner and Art. 6 (1) (f) GDPR in other cases, e.g. if your employer is ngena’s business partner).

2.4 Subscription
If you subscribe to ngena’s blog news alerts, you have to provide your email address to enable ngena to send you the updates (the legal basis for data processing is Art. 6 (1) (a) GDPR). ngena will use your email address to send you company news as long as you are a subscriber. Of course, you can unsubscribe at any time and ngena will delete your data.

If you subscribe to ngena’s press releases and company news, you have to provide your name, your email address and the name of your company. You may also choose to inform ngena about your position. ngena will use your email address to send you company news as long as you are a subscriber, and ngena may use the additional information which you provided in order to select the news which are more relevant to you (the legal basis for data processing is Art. 6 (1) (a) GDPR). Of course, you can unsubscribe at any time and ngena will delete your data.

If you subscribe to ngena’s updates by other means (e.g. via personal contact with ngena’s representatives), ngena will verify your subscription by sending a verification email to you and then act in accordance with your confirmation (the legal basis for data processing is Art. 6 (1) (a) GDPR). Of course, you can unsubscribe at any time and ngena will delete your data from the subscribers database.

ngena’s newsletters may contain marketing functionalities which allows ngena to determine whether you have read the newsletter and whether you clicked on any links.

2.5 ngena .connect

ngena .connect means the portal available via login page at https://connect.ngena.net.

(a) If the company, for which you work, has requested ngena to grant you access to ngena .connect, ngena will usually receive your first name, last name and email address from your company and ngena will know that you work at that company. ngena will use the data to set up a user account for you so that you can access ngena .connect as requested by your company. As you use ngena .connect, ngena will store information on your activities such quotes you requested, orders you placed, tickets you opened, etc. so that ngena can support the business project which you pursue (the legal basis for data processing is Art. 6 1 (f) GDPR).

Your data will be stored by ngena as long as you are an active user of ngena .connect. If you stop being an active user of ngena .connect (for example, you don’t use ngena .connect for a longer period or your company has requested to terminate your access), your user account will be deactivated and your data will be restricted from further use. After a further period, your data will be deleted (anonymized).

In addition, you can ask ngena to delete your user account and your data at any time.

(b) Cookies on ngena .connect: ngena may use security cookies and session cookies on ngena .connect. Security cookies are used in order to ensure the safety and security of ngena .connect, in particular, to protect against attempted attacks on ngena systems. Session cookies are used to ensure the smooth functionality of ngena .connect, for example, to identify whether you are already logged in. The legal basis for data processing with use of cookies is Art. 6 (1) (f) GDPR.

(c) Log files: the log files on access to ngena .connect are stored for security and user management purposes for a period of 90 days.

2.6 QuickSizer.net 

(a) Your account with QuickSizer.net: You can set up a user account with QuickSizer.net based on your business email address. The account is created after you go through the registration process on the login page of QuickSizer.net.

ngena will use your email address to set up a user account on your request so that you can access QuickSizer.net (the legal basis for data processing is Art. 6 (1) (a) GDPR). Your email address will be stored by ngena as long as you are an active user of QuickSizer.net. If you stop being an active user of QuickSizer.net (for example, you don’t use QuickSizer for 90 days), your user account will be deleted.

If you choose to provide your phone number to ngena during the registration process, you consent to ngena contacting you for marketing purposes related to ngena’s services (the legal basis for data processing is Art. 6 (1) (a) GDPR).

If your company is not a registered partner of ngena, then in order to view prices on QuickSizer.net, you must enter your phone number and verify your identity through a code you receive on your phone for security purposes. Your phone number submitted for this purpose is deleted within 72 hours (the legal basis for data processing is Art. 6 (1) (f) GDPR).

In addition, you can ask ngena to delete your user account and your data at any time.

(b) Use of QuickSizer.net: ngena will receive information about the selling opportunity, which you quote in QuickSizer.net, analyse such information and take action to facilitate the selling process, e.g. contact you and discuss the next appropriate steps (the legal basis for data processing is Art. 6 (1) (b) GDPR).

(c) Log files: the log files on access to QuickSizer.net are stored for security and user management purposes for a period of 90 days.

2.7 Repository

(a) If the company, for which you work, has requested ngena to grant you access to the Repository, ngena will usually receive your first name, last name and email address from your company. ngena may also receive your work phone number and your job title, and ngena will know that you work at that company.

ngena will use the data to set up a user account for you so that you can access the Repository as requested by your company (the legal basis for data processing is Art. 6 1 (f) GDPR). Your data will be stored by ngena as long as you are an active user of the Repository. If you stop being an active user of the Repository (for example, you don’t use the Repository for a longer period or your company has requested to terminate your access), your user account will be deactivated and your data will be restricted from further use. After the further period of up to 90 days, your data will be deleted (anonymized).

(b) ngena may use security cookies and session cookies on the Repository. Security cookies are used in order to ensure the safety and security of the Repository, in particular, to protect against attempted attacks on ngena systems. Session cookies are used to ensure the smooth functionality of the Repository, for example, to identify whether you are already logged in. The legal basis for data processing with use of cookies is Art. 6 (1) (f) GDPR.

(c) Log files: the log files on the use of the Repository by registered users are stored for security and user management purposes for a period of 30 days.

3. Will my data be passed on to third parties?
ngena may involve third-party providers for supporting its IT systems (e.g. hosting providers and providers of software enabling certain features of the Websites) and your data may be processed by such providers. Such providers are only involved on the basis of a data processing agreement with ngena which ensures the security and confidentiality of your data. These providers may also be based outside of the EU; non-EU based providers are only involved after the extensive check whether the provider offers the same level of data protection as required by the EU laws, and on the basis of a specific data processing agreement which ensures the same level of data protection as required by the EU laws.

In certain cases ngena may be legally obliged to pass on data on request of a state body.

ngena does not pass on your data to third parties for any other purpose.

4. What rights do I have?

You may request, free of charge, information about your data stored by ngena.

You may request the correction of your data in case the data stored by ngena is incorrect.

You may also request the deletion or restriction of processing of your data, as well as the provision of your data to you or to another controller in a structured machine-readable format.

In addition, you have the right to lodge a complaint with a supervisory authority. The supervisory authority responsible for ngena is „Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen” (www.ldi.nrw.de).
